Region’s Coal Plants, Industry Could Face Change Under Kagan
Environmental groups are praising the appointment of Elena Kagan to the U.S. Supreme Court. But Legal Affairs Director for the Ohio Environmental Council, Trent Dougherty, says she’s likely to have her work cut out for her – especially when it comes to cases involving the Clean Air Act in the Ohio River Valley.
“The Ohio Valley, Ohio, Kentucky, other states that are big producers of greenhouse gases from our legacy coal plants and other industrial facilities are going to be faced with a series of greenhouse gas-related regulations from the U.S. EPA and perhaps, in the future, some congressional changes,” says Dougherty.
And Dougherty says states and organizations are already lining up to challenge those changes in courts around the country. He says those cases are likely to appear before the U.S. Supreme Court, and a newly appointed Kagan, in the next few years.
